💳Information regarding bank cards and money transfers!

💰The National Bank of Ukraine has banned authorized institutions from conducting any foreign exchange transactions using Russian and Belarusian rubles, as well as transactions involving a legal entity or individual located in Russia or Belarus.
In addition, from 1 March 2022 it is prohibited to credit funds to the accounts of individual clients for transfers using payment cards of banks in the Russian Federation and Belarus.
It is also prohibited to accept in Ukraine payment cards issued by banks of these countries - in particular, to make transfers, settlements and cash withdrawals.
💵Thus, it is no longer possible to exchange the Russian and Belarusian ruble for the Ukrainian hryvnia in banks and exchange offices, and it is no longer possible to pay with payment cards issued in the Russian Federation and Belarus in stores.

💳Информация, касающаяся банковских карт и денежных переводов!
💰Национальный банк Украины запретил уполномоченным учреждениям проводить какие-либо валютные операции с использованием российских и белорусских рублей, а также операции, участником которых является юридическое или физическое лицо с местонахождением в России или Беларуси.
Кроме того, с 1 марта 2022 года запрещено зачисление средств на счета клиентов – физических лиц по переводам с использованием платежных карт банков РФ и Беларуси.
Также запрещается принимать в Украине платежные карты, эмитированные банками этих стран – в частности, производить переводы, расчеты и выдачу наличных денег.
💵Таким образом, более невозможно обменять российский и белорусский рубль на украинскую гривну в банках и обменных пунктах, а платежными картами, выданными в РФ и Беларуси, более невозможно рассчитаться в магазинах.

🗞️About eDocument for the period of wartime.
If you previously received an individual taxpayer number in Ukraine and have an account with💰 Privatbank / Monobank, as well as the corresponding mobile applications of these banks, then you can use the new service from the «Diia» application: eDocument.
"eDocument" - a digital certificate for the period of wartime in case of loss of documents (including passport of a refugee/person in need of complementary protection, “Dovidka”.
"eDocument" contains the necessary information:
-✅Full Name;
-✅gender and date of birth;
-✅citizenship (not always indicated correctly);
-✅a document that certifies the identity (if any);
-✅ individual taxpayer number;
-✅ place of residence;
-✅ foto
-✅ QR code for identity verification.

This will help citizens who have lost their documents due to the war to certify their identity, if necessary, during checks on the territory of Ukraine. It will be recognized by state authorities, the National Police, the military at checkpoints.

If you are already using the "Diia" application, and the new document is still not available, you need to update the application.
If you do not use the "Diia" application, then below find step-by-step instructions on how to install it.

📲You can do this on Google Play (if using the Android OS) or the App Store (if you have an iPhone). When the download is complete, click on the application icon and follow a few simple steps:
think up and enter a four-digit code;
repeat the code again;
allow further biometric login to the app.

«еДокумент» - цифровое удостоверение на период военного положения в случае утери документов (в том числе, удостоверения беженца / лица, которому предоставлена дополнительная защита, справки об обращении за защитой в Украине (Довидки).
«еДокумент» содержит необходимую информацию:
- ✅фамилия, имя, отчество;
- ✅пол и дата рождения;
- ✅гражданство (не всегда указывается корректно);
- ✅документ, которые удостоверяет личность (при наличии);
- ✅индивидуальный налоговый номер;
- ✅место проживания;
- ✅фотографию
- ✅QR-код для подтверждения личности.

Это поможет гражданам, которые из-за войны потеряли документы удостоверять при необходимости свою личность при проверках на территории Украины. Его будут признавать органы государственной власти, Национальная полиция, военные на блокпостах.

Если Вы уже пользуетесь приложением «Дія», а новый документ все еще недоступен, необходимо обновить приложение.
Если же Вы не пользуетесь приложением «Дія», то ниже можете найти пошаговую инструкцию, как его установить.

📲Сделать это можно на Google Play (при использовании ОС Android) или App Store (если у вас iPhone). По завершении загрузки нажмите на иконку приложения и сделайте несколько простых шагов:
идентифицируетесь через Приват24, BankID (Вы перейдете в приложение Приват24, необходимо выполнить шаги, указанные там);

‼ The State Migration Service continues to work in Ukraine‼

📅From March 15, territorial bodies and territorial subdivisions of the State Migration Service, which are located in safe areas where no active hostilities , will continue work on receiving and providing administrative services, in particular, documents for ID-cards, foreign passports and Ukrainian passports, temporary residence.

❗️Миграционная служба возобновляет работу в Украине❗

📅С 15 марта территориальные органы и территориальные подразделения ДМС, КОТОРЫЕ НАХОДЯТСЯ В БЕЗОПАСНЫХ РАЙОНАХ, где не ведутся активные боевые действия, возобновляют работу по приему и предоставлению административных услуг, в частности, документов для оформления ID-карты, загранпаспорт граждан временное проживание.

📸 Также ДМС будет осуществлять вклеивание фотографий в паспорт гражданина Украины в форме книжечки, продлевать срок действия загранпаспортов и вносить сведения о детях, в частности, речь идет о вклеивании фотографии в загранпаспорт родителей, что дает возможность гражданам свободно пересекать границу, спасаясь от войны.

🔹Отныне граждане, потерявшие документы или срок действия которых истек, могут обращаться в определенный орган ДМС, работающих с учетом соблюдения безопасности условий военного положения.
🔸 Напомним, что оформление документов возможно осуществить в любом территориальном органе или подразделении ДМС, независимо от зарегистрированного места жительства.

К БФ «Право на Защиту» обратились лица, требующие дополнительной защиты, с просьбой разъяснить для органов власти страны ЕС суть дополнительной защиты в Украине. Это разъяснение было необходимо для подачи заявления на временную защиту в стране ЕС.
Разъяснение:
Дополнительная защита предоставляется на основании Закона Украины «О беженцах и лицах, требующих дополнительной или временной защиты» (перевод закона на английский язык можно найти по ссылке https://www.iom.org.ua/en/legislation/migration-related-legislation/on-refugees-and-persons-in-need-of-complementary-or-temporary-protection-in-ukraine.html ) и означает «эквивалентную национальную защиту» в Украине в соответствии со статьей 2(1)(b) Исполнительного решения Совета (ЕС) 2022/382 от 4 марта 2022 года, устанавливающего наличие массового притока перемещенных лиц из Украины по смыслу статьи 5 Директивы 2001/55/ЕС и имеющего эффект введения временной защиты.
Данный вывод был сделан в Сообщении Комиссии об оперативном руководстве к реализации Исполнительного решения Совета (ЕС) 2022/382, устанавливающего наличие массового притока перемещенных лиц из Украины по смыслу статьи 5 Директивы 2001/55/ЕС и имеющего эффект введения временной защиты. CF “Right to Protection” was approached by persons granted complementary protection with a request to explain to the authorities of the EU country the essence of complementary protection in Ukraine. This clarification was necessary to apply for temporary protection in an EU country.
Explanation:
Complementary protection is granted based on the LAW OF UKRAINE on Refugees and Persons in need of Complementary or Temporary Protection in Ukraine (translation by IOM is here https://www.iom.org.ua/en/legislation/migration-related-legislation/on-refugees-and-persons-in-need-of-complementary-or-temporary-protection-in-ukraine.html) and means “equivalent national protection” in Ukraine under Article 2(1)(b) of the Council Implementing Decision (EU) 2022/382 of 4 March 2022 establishing the existence of a mass influx of displaced persons from Ukraine within the meaning of Article 5 of Directive 2001/55/EC, and having the effect of introducing temporary protection.
The same conclusion was made at COMMUNICATION FROM THE COMMISSION on Operational guidelines for the implementation of Council implementing Decision 2022/382 establishing the existence of a mass influx of displaced persons from Ukraine within the meaning of Article 5 of Directive 2001/55/EC, and having the effect of introducing temporary protection.
The documents issued to the beneficiaries of this form of protection are: ‘travel document for persons granted complementary protection’, ‘certificate for persons granted complementary protection”.

Вопрос: Я нахожусь в Германии. У меня дополнительная защита. Как долго я смогу здесь находиться?
Ответ: Если Вы подадитесь на временную защиту, то срок Вашего пребывания в стране будет зависеть от развития войны в Украине. Вы получите документ на проживание, который будет действовать 1 год. Он может быть продлен, если война в Украине не закончится к моменту завершения срока его действия.
Вопрос: Если я попрошу временную защиту, заберут ли у меня мой документ о дополнительной защите в Украине? Смогу ли я работать?
Ответ: Если вы обратитесь за временной защитой, то Орган регистрации иностранных граждан выдаст вам разрешение на проживания, в котором будет указано о вашем праве на работу. В нормативно-правовых актах ЕС по временной защите нет требования сдавать паспортный документ на хранение.
Вопрос: Если мы подадимся на временную защиту, сможем ли навестить родственников в Украине?
Ответ: Временная защита не предполагает возможности путешествий/посещения родственников. Вы сможете находиться в безопасности в Германии пока будет война.
Вопрос: Смогу ли я после окончания временной защиты податься на статус беженца?
Ответ: По общему правилу после окончания временной защиты вы должны вернуться в страну вашего проживания, т.е. в Украину. Однако это обязанность не лишает вас права подать заявление о признании беженцем.

🇩🇪🇩🇪🇩🇪Group of Questions on Temporary Protection in Germany🇩🇪🇩🇪🇩🇪

Question: I am in Germany. I was granted complementary protection in Ukraine. How long can I stay here?
Answer: If you apply to temporary protection, then the duration of your stay in the country will depend on the development of the war in Ukraine. You will receive a residence document that will be valid for 1 year. It can be extended if the war in Ukraine is not over by the time it expires.
Question: If I apply for temporary protection, will my CP- document be taken from me? Will I be able to work?
Answer: If you apply for temporary protection, the Aliens Registry will issue you a residence permit that states your right to work. There is no requirement in EU regulations on temporary protection to deposit a passport document.
Question: If I apply for temporary protection, will I be able to visit relatives in Ukraine?
Answer: Temporary protection does not include the possibility of traveling/visiting relatives. You will be safe in Germany as long as there is a war.
Question: Will I be able to apply for refugee status after the end of temporary protection?
Answer: As a general rule, after the end of temporary protection, you must return to your country of residence, i.e. to Ukraine. However, this duty does not deprive you of the right to apply for refugee status.

‼️Вопрос о порядках 🪖военного положения🪖 и нарушениях прав человека.‼️

❓Вопрос: Могут ли меня в период военного времени без оснований задержать, проверить мои вещи, забрать документы?

❗️Ответ: Согласно статье 1 Закона Украины “О правовом режиме военного положения”, военное положение - это правовой режим, который предусматривает предоставление соответствующим органом государственной власти, военному командованию, администрациям и органам местного самоуправления полномочий, необходимых для предотвращения угрозы, отпора вооруженной агрессии и … обеспечения национальной безопасности, а также временное ограничение конституционных прав и свобод человека с указанием срока действия этих ограничений.

✅В период военного времени не разрешается без оснований задерживать, проверять вещи и изымать документы!

Порядок проверки документов, досмотра вещей, транспортных средств, багажа и грузов, служебных помещений и жилья граждан во время обеспечения правового режима военного положения, утвержден постановлением КМУ от 23.12.2021 № 1456.

Этот Порядок устанавливает, что уполномоченное лицо имеет право требовать предоставления документов, удостоверяющих личность в следующих случаях:

🟢если лицо имеет внешние признаки, похожие на признаки лица, которое пребывает в розыске, или без вести пропавшего лица;
🟢если существует достаточно оснований считать, что лицо осуществило или имеет намерение осуществить правонарушение;
🟢если лицо пребывает на территории или объекте со специальным режимом;
🟢если у лица есть оружие, боеприпасы, наркотические средства и другие вещи, оборот, которых ограничен, или запрещен, или для хранения, использования или перевозки нужно разрешение, если установить такие права другим способом невозможно;
🟢если лицо находится на месте совершения уголовного, административного правонарушения или дорожно-транспортного происшествия, другой чрезвычайной ситуации;
🟢если внешние признаки лица или транспортного средства или действия лица дают достаточные основания считать, что лицо причастно к совершению преступления, транспортное средство может быть средством или объектом совершения преступления;
🟢нарушение лицом соответствующих запретов, введенных на территории, где установлен режим военного положения.

The issue of martial law and violations of human rights.

Question: Are there any norms that allow to detain person or check his/her belongings or take away documents without reasons during wartime ?
Answer: According to Article 1 of the Law of Ukraine “On the legal regime of martial law”, martial law is a legal regime that provides powers necessary to prevent a threat, repel armed aggression and ... ensure national security for the relevant state authority, military command, administrations and local governments, as well as temporary restriction of constitutional rights and freedoms of a person, indicating the duration of these restrictions.
During wartime, it is not allowed to detain, check things and seize documents without reason!
The procedure for checking documents, inspecting things, vehicles, luggage and cargo, office premises and housing of citizens during the enforcement of the legal regime of martial law, was approved by the Cabinet of Ministers of 23 December 2021 No. 1456.
This Procedure establishes that the authorized person has the right to demand the provision of identification documents in the following cases:
- if the person has external features similar to those of a wanted person or a missing person;
- if there are sufficient grounds to believe that the person has committed or intends to commit an offense;
- if a person stays in a territory or facility with a special regime;
- if a person has weapons, ammunition, narcotic drugs and other things, the circulation of which is restricted or prohibited, or a permit is required for storage, use or transportation, if it is impossible to establish such rights in another way;
- if a person is at the scene of a criminal, administrative offense or a traffic accident, other emergency situation;
- if the external signs of a person or a vehicle or the actions of a person give sufficient grounds to believe that the person is involved in the commission of a crime, the vehicle may be the means or object of the crime;
- in case of violation by a person of the relevant prohibitions imposed on the territory where martial law is established.
